A Constitutional Amendment to Create a Tripwire for Capital Punishment
Be it enacted by the Senate and House of Representatives of the State of Firestone in Congress assembled,
SECTION 1. SHORT TITLE
This bill may be known as the “Capital Punishment Enabling Amendment”.
SEC. 2. EFFECTIVENESS
This Act shall be effective upon completion of the constitutionally required process.
SEC. 3. DEFINITIONS
For the purposes of this amendment–
(1) “capital punishment” means the state-sanctioned, judicially ordered execution of a person upon conviction for a capital offense as defined by statute.
SEC. 4. AMENDMENT
(a) Article III, Section VII, Subsection IV of the Constitution currently states:
Judicially imposed sentences shall be just and lawful. No period of incarceration greater than three hours shall be imposed. Furthermore, a criminal penalty cannot be imposed for liability in civil litigation. Judicial sentences shall not be limited to incarceration (nor shall other, non-carceral remedies be limited by the maximum prison time) or any provision herein, though can include penalties such as punishments in a relevant department, community service, or other such penalties as the legislature may detail by statute. No punishment shall be cruel or unusual.
(b) Article III, Section VII, Subsection IV of the Constitution shall be amended to state:

No punishment shall be cruel or unusual. Capital punishment and the execution thereof in and of itself shall not be construed as cruel and unusual punishment.
