Secondary Identification Presentation Act

Be it enacted by the State of Firestone Congress here assembled,
§ 1. TITLE
(a) This Act shall be known as the “Secondary Identification Presentation Act”
§ 2. ENACTMENT
(a) This Act shall go into effect upon the completion of the constitutionally required processes.
§ 3. SEVERABILITY
(a) Should any part of this Act be struck down or declared unenforceable, that part shall be severed, with the remainder left in full force and effect unless the entirety is struck down.
§ 4. DEFINITIONS
(a) For the purposes of this Act, the Firestone Criminal Code, as described by the Criminal Code Revision Act (R), shall be defined as: Trello
(b) “Actively fishing” shall mean casting a line, reeling, baiting, or otherwise engaging in the act of fishing.
(c) “Fishing license” shall refer to any valid license issued by the appropriate authority permitting an individual to fish within the State of Firestone.
§ 5. AMENDMENTS
(a) Chapter 1, Section 7 of the Firestone Criminal Code shall be added to and amended.
(i) Chapter 1, Section 7 currently states:
(a) The act of failure to present identification shall be recognized as an unlawful criminal offense within the State of Firestone.
(a1) Failure to present identification shall be the act of failing to provide a subject’s ingame Firestone State issued identification card to peace officers, given that the officer has probable cause or reasonable suspicion, as prescribed by other legislation, to make such a demand.
(b) The act of providing false identification shall be recognized as an unlawful criminal offense within the State of Firestone.
(b1) The act of providing false identification shall be the act of knowingly identifying oneself as someone that the subject is not, to a peace officer that has probable cause or reasonable suspicion, as prescribed by other legislation, to make such a demand.
(ii) Chapter 1, Section 7 shall be amended to state:
§7 – FAILURE TO PRESENT IDENTIFICATION
(a) The act of failure to present identification shall be recognized as an unlawful criminal offense within the State of Firestone.
(a1) Failure to present identification shall be the act of failing to provide a subject’s ingame Firestone State‑issued identification card to peace officers, given that the officer has probable cause or reasonable suspicion, as prescribed by other legislation, to make such a demand.
(b) The act of failing to present a fishing license, under qualifying circumstances, shall also be recognized as failure to present identification within the State of Firestone.
(b1) Failing to present a fishing license shall be the act of failing to provide a valid fishing license to a peace officer or state agency with jurisdiction, only when the officer or agency has probable cause to believe the individual is actively fishing. Mere possession of fishing equipment, being on a boat, or being near a fishing area shall not constitute probable cause. The requirement to possess or present a fishing license shall be suspended during any Free Fishing Day or such similar event. An event of this description shall be designated by the Parks Director or their designee, provided such designation is publicly announced prior to taking effect.
(c) The act of providing false identification shall be recognized as an unlawful criminal offense within the State of Firestone.
(c1) The act of providing false identification shall be the act of knowingly identifying oneself as someone that the subject is not, to a peace officer that has probable cause or reasonable suspicion, as prescribed by other legislation, to make such a demand.
(d) This offense shall carry a variable sentencing range, and must be specifically identified with the originating criminal offense(s) in any charging document or arrest filing.
(d1) Violations of §7(a) and §7(a1) shall carry a sentencing range of 300–420 seconds, classified as a Misdemeanor B.
(d2) Violations of §7(b) and §7(b1) shall carry a $200 citation, classified as a Misdemeanor C.
(d3) Violations of §7(c) and §7(c1) shall carry a sentencing range of 300–420 seconds, classified as a Misdemeanor B.
