The District Police Act

Be it enacted by the District of Prominence Council here assembled that,
§1. Title
a. This Ordinance shall be known, and may be cited as, the “The District Police Act”.
§2. Enactment
a. This Ordinance shall take effect immediately upon completion of all procedures mandated by the District Charter.
§3. Severability
a. Should any provision of this Ordinance be struck down or declared unenforceable, then that provision shall be severed and the remaining provisions shall continue in full force and effect, unless the entirety is declared invalid or unenforceable.
§4. Enforcement
a. This Ordinance shall be enforced by all relevant parties.
§5. Definitions
a. The Prominence District Police shall be defined here.
b. The POST Certification Protection Act of 2024 shall be defined here.
§6. Establishment
a. The Prominence District Police (herein, the “Department”) shall be established as a Department under the District of Prominence.
b. The Department shall be tasked to enforce municipal law on behalf of the District, and shall also enforce the laws of superior governments. Furthermore, the Department shall be tasked with the security of municipal buildings.
c. The Department shall have jurisdiction within the municipality as defined by superior law.
d. The Prominence District Police shall be designated as a Law Enforcement Agency, hence all non-civilian personnel employed therein must possess and maintain a current POST Certification, as established by the POST Certification Protection Act of 2024.
§7. Provisions
a. The Department shall be led by a Chief of Police, an executive office within the District of Prominence, and shall report directly to the Mayor. The Chief of Police shall be nominated by the Mayor and pass by the Council with a simple majority vote.
b. The Chief of Police shall appoint an Assistant Chief of Police, an executive office within the District of Prominence, who shall report to the Chief of Police. In the absence of the Chief of Police, the Assistant Chief shall assume the same powers of the Chief of Police.
c. The Chief of Police shall present a report detailing the state of the Department on a monthly basis to the Mayor.
d. Both the Chief of Police and Assistant Chief of Police shall have the power to implement department policies affecting its employees. Such policies may not contravene employment law and may be overturned by the Mayor of the District of Prominence.
e. The Chief of Police may delegate responsibilities to the Assistant Chief and other employees as they see fit.
§8. Employment
a. The Chief of Police may hire and employ Officers and Recruits in accordance to the following criteria:
i. They completed an application that is open to the public.
ii. They hold an active POST Certification.
iii. They do not have a Public Safety Blacklist.
iv. They have neither arrests nor more than two misdemeanor citations.
b. The Chief of Police may hire civilian employees, who retain no law enforcement powers, in accordance to the following criteria:
i. They do not have a Public Safety Blacklist.
ii. If they have a criminal record, the Chief must prepare a risk assessment for that individual which details what mitigations will be put in to place to ensure the employee does not violate the law while representing the department, and is subject to the Mayor’s approval.
c. Only officers of the department shall hold the authority of a law enforcement officer as defined by superior law. No civilian employee or recruit shall hold such authority, except when partaking in a field training as defined by the Chief of Police.
d. The Chief of Police, Assistant Chief of Police and their designees shall have the authority to issue disciplinary action to any member of the department when in violation of policy established via Section §7d.
e. Promotions of at least three (3) ranks shall require the consultation and consent of the Mayor of the District of Prominence.
f. The Chief of Police or their designee shall establish a training program which must be completed by all individuals - excluding civilian employees - applying to the department. No one shall be granted the ability to patrol until this is met, unless they are partaking in field training as defined by the Chief of Police. This requirement may be waived with the Mayor’s approval or if an individual is reinstating within 3 months of their previous employment with the Prominence District Police. Employees laterally transferring to the Department shall only be required to complete an expedited training program as determined by the Chief of Police.
§9. Nullifications
The District Police Establishment Act of 2022 shall be declared null and void.
